Terms of Service

Effective Date: August 30, 2026

1. Agreement to These Terms

GexLog is operated by an individual doing business as GexLog, located in the State of Minnesota, United States (the "Operator", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the website at gexlog.com, its subdomains including the machine-readable API at agent.gexlog.com (the "API"), the WebMCP tools exposed on our pages, and the content we publish through them (together, the "Service").

By accessing this website or using the GexLog API, you agree to these Terms. If you do not agree, do not use the site or the API. These Terms also apply to any automated client, agent, or script that accesses the Service; the person or organization operating that client is responsible for its compliance.

2. Eligibility and Intended Audience

You must be at least 18 years old to use the Service. The Service is intended for and directed to users in the United States. We do not offer the Service to, or target, residents of the European Economic Area, the United Kingdom, or Switzerland, and we do not intend to subject ourselves to the GDPR or the UK GDPR. If you access the Service from outside the United States, you do so on your own initiative and are responsible for compliance with local law.

3. Not Investment Advice; Publisher's Role

GexLog is an impersonal financial publication of general and regular circulation. All content, including GO/CAUTION/WAIT signals, day-type forecasts, playbooks, key levels, narratives, and any scored or ranked output, is general market commentary published to the public on a fixed schedule. It is not, and is not intended to be, personalized investment advice, a recommendation to any particular person, or an offer or solicitation to buy or sell any security or other instrument. The Operator is not a registered investment adviser, broker-dealer, or commodity trading advisor and does not manage money or accounts for any person. Nothing on the Service is tailored to your financial situation, objectives, or risk tolerance. Consult a licensed professional before trading. Our Financial Disclaimer is incorporated into these Terms by reference.

4. Market Data and Derived Analytics

Market data on the Service is obtained from third-party providers (including Tradier and Financial Modeling Prep) and is captured as scheduled snapshots, typically before the market opens and after it closes. The Service does not provide real-time or streaming market data. Data may be delayed, incomplete, or inaccurate, and is provided on an "as is" basis without any warranty of accuracy, completeness, or timeliness. Values such as gamma exposure (GEX), put and call walls, the GEX flip and zero-gamma levels, expected move, pivots, and regime classification are derived analytics calculated by our models from third-party data. They are estimates, not observations of actual market positioning.

You may not redistribute, resell, sublicense, or republish market data or derived analytics obtained from the Service or the API, except as expressly permitted in Section 6.

5. Acceptable Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates applicable federal, state, local, or international law, including economic sanctions laws.
  • Scrape, spider, crawl, or harvest the website or its data by any automated means. Automated access is permitted only through the documented API at agent.gexlog.com and the WebMCP tools we publish, subject to Section 6.
  • Circumvent or attempt to circumvent payment requirements, rate limits, access controls, or any security measure, or reuse, replay, or forge a payment authorization, receipt token, or partner key.
  • Interfere with the proper working of the Service, or introduce viruses, malicious code, or excessive load.
  • Impersonate the Operator or any other person, or misrepresent your affiliation with GexLog.
  • Systematically copy our content or derived analytics to build a competing data product.

6. Agent API Terms

The following additional terms apply to the API at agent.gexlog.com.

  • Payment and finality. Certain API routes are priced per request and payable in USDC through the x402 protocol on the networks we support. Prices are published in the API's HTTP 402 payment responses and in its OpenAPI specification. All payments are final and non-refundable. You are solely responsible for your wallet, private keys, network selection, and any gas or network fees. We never take custody of your keys or funds; we only receive USDC paid for API access into our own wallet.
  • Receipt tokens and replay protection. A successful payment returns a receipt token that permits re-fetching the same resource, with the same parameters, for up to 15 minutes without a second payment. A request that fails after a valid payment may be retried with the same payment authorization within 15 minutes and will not be settled twice. Do not attempt to reuse or replay a payment authorization or receipt token outside these conditions.
  • Prices, routes, and schemas. Prices, routes, rate limits, and response schemas may change at any time. We will make reasonable efforts to publish breaking changes in the OpenAPI specification but do not guarantee backward compatibility.
  • Rate limits and fair use. API access is rate-limited per IP address and per partner key. We may throttle, suspend, or revoke access for abuse or excessive use at our discretion.
  • Partner keys. Bearer partner keys are issued only by direct arrangement with the Operator. They are confidential, non-transferable, and revocable at any time in our sole discretion. You are responsible for all use of your key.
  • Data license. Data obtained through the API is licensed to you for your internal use, including use by your own applications and AI agents. You may not resell, redistribute, sublicense, or publicly republish the data, or cache it beyond your operational need.
  • Availability. The API is provided "as is" and "as available" with no uptime guarantee. We may modify, suspend, or discontinue the API or any route at any time.
  • Lawful use and sanctions. You represent that you are not located in, organized under the laws of, or acting on behalf of any jurisdiction or person subject to United States sanctions, and that your use of the API complies with all applicable laws, including OFAC sanctions.
  • Payment facilitators. Payment verification and settlement are performed by third-party x402 facilitators (including the Coinbase Developer Platform facilitator and Circle). Your use of those services is also subject to their terms. Blockchain transactions are public and permanent and are outside our control.

7. Advertising and Affiliate Links

The Service displays sponsored placements labeled "Ad" and contains affiliate links to third-party products and services, currently including TradingView and Option Alpha. If you click an affiliate link and sign up or make a purchase, we may earn a commission at no additional cost to you. Affiliate relationships do not influence our data, signals, or analysis. A link to a third party does not mean that the third party endorses GexLog, or that we endorse the third party. See the Financial Disclaimer for our full affiliate disclosure.

8. Third-Party Websites and Platforms

The Service links to third-party websites and services that we do not own or control. We are not responsible for their content, privacy practices, or terms, and you acknowledge that the Operator is not liable for any damage or loss caused by your use of them. Content we publish on third-party platforms, including The Gamma Brief on YouTube, is subject to those platforms' terms. Any membership, subscription, or purchase you make on such a platform is sold and billed by the platform, not by GexLog, and the platform handles its own renewals, refunds, and cancellations.

9. Intellectual Property and Infringement Notices

The Service and its original content, features, and functionality (excluding underlying third-party market data) are owned by the Operator or licensed from third parties and are protected by copyright, trademark, and other laws. You may not copy, redistribute, or create derivative works from the Service without our prior written permission, except as permitted by Section 6 or applicable law. The GexLog name, logo, and trade dress may not be used in connection with any product or service without our prior written consent.

If you believe content on the Service infringes your copyright, send a notice through our Contact Form identifying the copyrighted work, the material you believe is infringing and where it appears on the Service, and your contact information. We will review the notice and remove infringing material as appropriate.

10. Disclaimer of Warranties

THE SERVICE, ITS CONTENT, SIGNALS, DATA, AND THE API ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TIMELINESS, AND NON-INFRINGEMENT. THE OPERATOR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT, SIGNAL, OR DATA IS ACCURATE, COMPLETE, OR CURRENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, OR FOR ANY TRADING LOSSES, LOST PROFITS, OR LOSS OF DATA, ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, ITS CONTENT, OR THE API, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE OPERATOR'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO THE OPERATOR IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED UNITED STATES DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold harmless the Operator from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your trading decisions, your violation of these Terms, or your violation of any law or third-party right in connection with your use of the Service.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state courts located in Minnesota or the United States District Court for the District of Minnesota, and you consent to the personal jurisdiction of those courts.

14. Class Action Waiver

To the fullest extent permitted by law, you and the Operator agree that any dispute will be resolved on an individual basis, and you waive any right to bring or participate in a class, consolidated, or representative action or proceeding.

15. Changes to These Terms

We may modify or replace these Terms at any time at our sole discretion. The effective date at the top of this page indicates when the current version took effect, and material changes will be posted on this page. By continuing to use the Service after a revision becomes effective, you agree to be bound by the revised Terms.

16. General

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with the Privacy Policy and the Financial Disclaimer, are the entire agreement between you and the Operator regarding the Service.
